1. Acceptance of Terms

By accessing or using Vigilant ("the Service"), operated at vigilantstatus.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Vigilant provides hosted status pages and uptime monitoring. We monitor your endpoints, display public status pages, and send notifications when issues are detected. The Service is provided "as is" and may be updated at any time.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You are responsible for all activity that occurs under your account.

4. Acceptable Use

You agree not to:

  • Use the Service to monitor endpoints you do not own or have permission to monitor
  • Attempt to overwhelm, disrupt, or attack the Service or its infrastructure
  • Resell or redistribute the Service without written permission
  • Use the Service for any illegal purpose
  • Create status pages with misleading, fraudulent, or harmful content

5. Payment and Billing

Paid plans are billed monthly or annually in advance. All fees are non-refundable except within the first 14 days of a new subscription. We reserve the right to change pricing with 30 days notice. Downgrading from a paid plan may result in loss of features or data associated with the higher plan.

6. Data and Content

You retain ownership of all data you provide to the Service. We do not claim rights to your monitoring data, status page content, or subscriber lists. We may delete data associated with accounts that have been inactive for 12 months or more.

7. Service Availability

We aim for high availability but do not guarantee 100% uptime. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We are not liable for any damages resulting from Service downtime.

8. Limitation of Liability

To the fullest extent permitted by law, Vigilant and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Termination

You may cancel your account at any time. We may suspend or terminate accounts that violate these terms or for any other reason with reasonable notice. Upon termination, your data will be deleted within 30 days.

10. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or a notice on the Service. Continued use after changes constitutes acceptance.
